Alternative Approach to Disciplinary Proceedings

Mikel Alessio (Mik) was admitted to practice in 2004, he was an Accredited Specialist in Criminal Law and also an Accredited Specialist in Family Law. Mik operated a National Legal Practice across four (4) separate States in Melbourne, Sydney, Brisbane and Perth. 

Mik had never faced any disciplinary action in his sixteen (16) years of practice until 2020. 

The Victorian Legal Services Commissioner, Ms Fiona McLeay then in collaboration with Victoria Police Command decided to close the National Practice. This was done without procedural fairness, no notice to allow for time to respond to the basis for shutting down the practice and, massive financial losses were incurred. Monies were just taken from the practice. 

Mik was suspended from practice for a period of six (6) months until April Fools Day, on 1 April 2021. The suspension period certainly did end up being a somewhat joke, as there was never any intention to allow him to return to practice, in fact upon completing that suspension period Mik still had not been provided with the particulars to give him the information on what the supposed basis for shutting down his practice in fact was! 

Mik worked on various projects, cases and advocated for many varied causes, he was active in his local and broader community always helping others, prepared to put the interests of others before even his own often acting on a probono basis for no payment in this capacity. Some of the notable cases that Mik has worked on include: - 

  1. The Murrindindi Fire Captain representing his interests faced with accusations of killing 40 + people in Marysville in the Black Saturday Bushfires.
  2. He worked with Nicola Gobbo on Operation Quills, noting that this was the only matter subject to the present Tony Mokbel Appeals that led to a complete acquittal - Mik quietly takes some credit for this appeal outcome.
  3. He was a lead supporter of Rose Batty when she toured Australia with the Rose Batty Roadshow, supporting victims of domestic violence in no small way.
  4. He is also known for contributing to the Project Rescue Children charity for the recovery of children abducted overseas, supporting the safe return of children to Australia, by contributing to the charitable auction to purchase Schapelle Corby's parole papers. He subsequently provided assistance to Schapelle through John McLeod a well-known investigator who helps people caught up in international criminal cases across the World.
  5. Lloyd Rayney acting for this practitioner in his trial following his acquittal on murder in Western Australia, leading to a permanent stay of those proceedings put against Lloyd.
  6. Dr Craig Minogue known as the Russell Street Bomber he acted for liaising with co-Counsel advocating to the United Nations on human rights breaches; and
  7. Labelled Serial Killer Gregory Brazel Mik acted for at one point spending time with him at Barwon Prison and, identifying separate to his representation of Greg that his confession, Mik opines made by Greg to the Mordialloc Hardware Store murder was corrupted and taken by Homicide Squad Detective Sol Solomon in circumstances where he personally knew the victim making that confession a likely coerced and false confession too.
  8. Mik contributed furthermore to the COVID lockdown protester movement too, he aided prevention of harm to people in this sense through his engagement to ensure a safe environment was made as far as possible on that scene too.

Mik last year travelled to the United States of America to meet with people that have worked with the CIA and FBI learning more and becoming a highly skilled analyst through putting in thousands of hours of research in this field. Mik knows personally some very influential actors who contributed to the 911 Attacks in New York and subsequent handling of those terrorist organisations. Mik counts as friends people from a wide array of law enforcement, military and intelligence agencies across the World, this includes private intelligence organisations that have acted on the Me2 movement in relation for example, the Harvey Weinstein cases that are well known. 

Mik has an avid interest in the arts also, he has spent years supporting the arts being very active in this arena. He has produced various films featuring Nick Cave's late son Gethro Cave, and other films that have gone across the World and achieved International Acclaim on the topic of relationships, domestic violence and that are now used as an educational tool in American, Australian and other Countries Judicial Systems. Mik has undertaken studies in Government Investigations, AOD Counselling, he is also a proven heavy vehicle truck driver, removalist, salesperson, Jack of all trades type; and all round down to earth nice bloke. 

From his wealth of experiences, Mik has embarked on a mission to bring to Australia a Alternative Approach to Disciplinary Action. He has actively working with people across a large number of sectors to bring this mission to fruition, with persons from Government backgrounds, in the Private Sector and Psychological and Counselling fields, as too with individuals within the Personal Training and Fitness industry, and Professional bodies. 

The Alternative Approach to Disciplinary Action is estimated to bring cost savings into the literally hundreds of millions of dollars to not just the Victorian State Government but other States and Territories across Australia, that when combined will lead to into the Billions of dollars of cost savings and more streamlined application of Government resources. 

In the background, submissions have commenced being made to Government Ministers, Reports are being prepared and, collaboration is being sought with Regulatory Bodies across the Country. Mik is furthermore very active in Community Consultation, he talks to persons from all walks of life and he receives back information on how other industries operate to add to the cause that is his Mission. The details and fruits of these actions will progress on a continued basis until the Mission is complete, the Legal Profession is made better, and people working as legal practitioners and other associated fields are given back their human rights that at present the Legal Profession Uniform Law legislates away - that removes any human rights to be accorded to people who work as lawyers in this Country.
